Sec. 1 Scope
These terms apply to all contracts between chemmedia AG (provider) and businesses (Sec. 14 BGB) for use of the platform. Deviating customer terms apply only with express written consent.
Sec. 2 Conclusion and trial
The contract is concluded by selecting a plan and confirming. The free sandbox is for evaluation only (test voicing without real distribution) and can be ended at any time.
Sec. 3 Services and prices
The provider offers the features described in the selected plan as SaaS. Prices are shown at conclusion plus statutory VAT; "per month" refers to the monthly rate, and for annual billing the total for the billing period is due in advance.
Sec. 4 Term, obligations, AI labelling
The term follows the billing interval and renews unless cancelled. The customer must hold the necessary rights to submitted content; synthetic voices and avatars are labelled as AI and this labelling must not be removed. Custom avatars of real people require documented consent.
Sec. 5 Availability, liability, final provisions
The provider aims for high availability (maintenance windows and force majeure excepted). Liability is unlimited for intent and gross negligence and under mandatory law; for slight negligence only for breach of essential obligations, limited to foreseeable damage. German law applies (excluding the UN CISG); the place of jurisdiction is the provider's seat where permitted.
